Amendments to Regulation (EU) No 142/2011 on animal by-proudcts

Purpose

To advise you of Commission Regulation (EU) No 749/2011 which amends Regulation (EU) No 142/2011 on animal by-products.

Background

Regulation (EU) No 142/2011 implements Regulation (EC) No 1069/2009 laying down health rules are regards animal by-products and derived products not intended for human consumption.

The amendment relates to a number of issues, a summary of which are in the attached table.

The main issues to note for trade and imports are:

  • Specific requirements for fish oil for the production of medicinal products;
  • Amendment to Chapters I and II of Annex XIV to clarify the requirement for products to come from an approved establishment;
  • Product description for processed animal protein in Table 1 and Section 2, Chapter I of Annex XIV;
  • Rendered fats - Table 2 and Import Requirements in Chapter II of Annex XIV, and a new health certificate in Chapter 10(B) of Annex XV.

For a transitional period until 31 January 2012, consignments of rendered fats covered by certificate 10(B) of Annex XV to Regulation (EU) No 142/2011 shall continue to be accepted for importation into the Union, provided that the certificates were completed and signed before 30 November 2011.

This means that either certificate 10(B) laid down in Regulation (EU) No 142/2011 or Regulation (EC) No 1774/2002 can be used for imports of rendered fats until 31 January 2012, provided that the certificate is completed and signed before 30 November 2011.

Action for OVSs

To take note of the new rules including the transitional period for certification of imports of rendered fats.
